Welcome to Chikara LLC. By using our website and services, you acknowledge and agree to the terms outlined in this disclaimer. Please read it carefully before proceeding with any transaction.
1. Physical Condition of Vehicles
All vehicles offered by Chikara LLC are sold on an “As-is, Where-is” basis. We source our vehicles from Japanese auctions and trusted suppliers under the same terms. We provide up to 20 images for each vehicle upon arrival at our yard, along with available auction grade information.
We strongly encourage buyers to:
- Review the vehicle images thoroughly.
- Examine the condition grades shown on the listing page.
- Consult with our sales staff regarding any concerns before finalizing a purchase.
- Chikara LLC will not accept any claims related to mechanical, cosmetic, or functional issues—whether minor or major—after the vehicle has been shipped.
2. Faults in Accessories
We do not guarantee the functionality of any accessory or non-original equipment, including but not limited to:
- Audio systems (Radio, CD/DVD, Cassette players)
- Navigation systems
- Telephone systems
- CD changers and related components
3. Shipment Delays & Damage
Shipment Rescheduling: Chikara LLC is not responsible for delays or cancellations due to changes made by the shipping company or shipping agents.
Shipping Damage: We provide images of the vehicle as it enters our yard. We are not responsible for any damage occurring during or after shipment.
Customers may request insurance coverage at an additional cost to mitigate shipping risks.
Theft: We are not liable for any theft or missing accessories that occur in the yard, during shipment, or at the destination port.
4. Sale Cancellations
Chikara LLC may cancel a sale under rare circumstances. If so, we will compensate the buyer, except in cases involving:
- Faulty engine or transmission
- Vehicles failing inspection
- Radiation-contaminated units
If a vehicle cannot be procured or delivered, the buyer may request a refund or choose a replacement unit of similar specifications.
5. Refund Policy
Refunds, where applicable:
- Will be made minus bank transfer charges and any other deductions owed.
- Will only be sent to the registered bank account of the buyer.
- Will not cover exchange rate differences, buyer’s bank fees, or delays due to incomplete remittance information provided by the buyer.
6. Late Payments
Buyers must settle invoices within 72 hours of issue. Payments beyond this period are considered late and may result in:
- Additional fees and penalties
- Parking charges at the yard
- Cancellation or resale of the vehicle
- Chikara LLC reserves the right to pursue legal action for delayed balances.
Important: We do not accept screenshots, TT copies, or any form of proof as valid payment confirmation. Payment is only acknowledged once funds are fully received in our bank account and officially confirmed by our accounting team via email.
7. Payment Methods
- Accepted payment methods:
- Bank Telegraphic Transfers (TT)
- Credit Card (only through authorized channels)
- PayPal (officially listed addresses only)
Note:
- Buyers are responsible for all PayPal or bank-related charges.
- Buyers must notify their sales representative in writing after initiating any transfer.
- Payment to unofficial accounts will not be recognized.
8. Container Shipment & Delivery Delays
Container Damage: No claims are accepted for any damage that occurs during containerized shipping.
Sea Delays: We are not liable for any damage resulting from delivery delays at sea after the vessel has departed from Japan.
9. Bill of Lading (B/L) Changes
If Chikara LLC is at fault: We will cover the cost of any required amendments.
If the buyer provides incorrect information: The buyer will bear the full cost of correction.
